Terms of Service

These Terms of Service ("Terms") govern your use of the website at thescaleslab.com (the "Site") and the services provided by The Scales Lab ("we", "us", "our"), including our Amplify Instagram growth service (the "Services"). By using the Site or engaging our Services, you agree to these Terms.
1. The Services
The Scales Lab provides Instagram growth and engagement services. Our Amplify service performs outreach and engagement activity on your behalf — interacting with accounts in your target audience to grow your followers, engagement and inbound interest.
The scope of work, pricing and term for your engagement are set out in the proposal, onboarding form or written agreement provided to you. If anything in that document conflicts with these Terms, that document prevails.
2. Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract.
- You must own, or be authorised to manage, any Instagram account you connect to the Services.
- You are responsible for keeping the information you provide to us (including account access details) accurate and up to date.
3. Account access
To deliver the Services we may require login access to your Instagram account. We will only use that access to perform the Services. You are responsible for maintaining a valid, accessible account, and for telling us promptly if you change your password or enable settings that affect our access.
4. Third-party platforms
The Services interact with Instagram, which is owned and operated by Meta Platforms, Inc. We are not affiliated with, endorsed by or sponsored by Meta or Instagram. Your use of Instagram remains subject to Instagram's own Terms of Use and community guidelines, and you acknowledge that platform actions (including rate limits, restrictions or account reviews) are outside our control.
5. Results
We work to grow your account with real, targeted engagement, and we share typical results on the Site. However, growth depends on factors outside our control — including your content, niche, audience and changes to Instagram's platform — so we do not guarantee any specific number of followers, engagement rate or revenue outcome.
6. Fees and payment
- Fees are as agreed in your proposal or onboarding agreement and are payable in advance unless agreed otherwise.
- Subscriptions renew automatically for each billing period unless cancelled before the renewal date.
- Except where required by law, fees already paid are non-refundable once a billing period has commenced.
7. Your responsibilities
You agree not to use the Services for any unlawful purpose, and that your account content will not infringe any third party's rights or breach Instagram's rules. We may pause or end the Services if your account or instructions would put us, or your account, at legal or platform risk.
8. Intellectual property
The Site and its content (text, design, graphics and branding) are owned by The Scales Lab. You retain all rights to your own content and your Instagram account. Nothing in these Terms transfers ownership of either party's intellectual property to the other.
9. Limitation of liability
To the maximum extent permitted by law, The Scales Lab is not liable for any indirect, incidental or consequential loss (including loss of profits, followers, data or goodwill) arising from the Site or Services. Our total liability for any claim is limited to the fees you paid to us in the three (3) months before the event giving rise to the claim. Nothing in these Terms excludes rights you have under applicable consumer law that cannot be excluded.
10. Termination
Either party may end an engagement in line with the notice period in your agreement. We may suspend or terminate the Services immediately if you breach these Terms. On termination we will stop all activity on your account and, on request, confirm that access details have been removed from our systems.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows the current version. Continued use of the Site or Services after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Australia. Any dispute will be subject to the exclusive jurisdiction of the Australian courts.
